Asylum, Detention And Deportation/Zimbabwe
Subsequent, to reading your e-mail about the predicament of the Zimbabwean Asylum seeker, namely Jacob Mhlawisutu in anticipation of possible deportation. It has been called upon my mind to write something regarding this issue. I, like several other people in that situation sincerely sympathise with the affected individual. We as Zimbabweans understand why some people go such lengths of obtaining false documents to travel to place where they feel safe from the persecution they would have suffered in their home country. On the other hand many European governments are unwilling to accept asylum seekers who travel on false documents and who would have gone through a safe country. Those who advocate for asylum seekers argue and give possible reasons why asylum seekers travel this far instead of settling in the next safe country in accordance with the Geneva Convention of the status of refugees. They provide the following as reasons why asylum seekers end up in Europe instead of seeking refugee in a neighbouring African country; (a) asylum seekers sometimes travel to relatively distant countries that have few connections to their country of origin, even when they could have claimed asylum in nearby nation states with which they have strong colonial ties or where there exists linguistic similarity, (b) neighbouring countries may be dangerous, or be perceived by asylum seekers as being unsafe. (c)Thirdly, those people fleeing government instigated persecution may not wish to seek refuge in a country which has good political associations with their country of origin, primarily for fear of deportation. However, it must be understood that; asylum seeking is an emotive issue, with the rights of genuine refugees and those with untrue stories arousing strong political views.
If governments are to be consistent with international convention, refugee status should be given to people fleeing persecution in their own country. They are however faced with deciding which cases are genuine and this has proved to be a time-consuming and complicated process for both the asylum seeker and the authorities’ charged with the duty of making a decision. Those whose applications do not succeed are asked to leave the country or are deported.
Asylum seekers who are faced with the dilemma of physically getting into a safe country, in some cases end up forging documents, and risk being refused or deported upon arrival. Asylum law requires asylum seekers, upon arrival to declare to an immigration officer when they arrive that they wish to claim asylum. The Official upon receiving such information should grant the asylum seeker stay if his life or freedom would be threatened on account of his or her race, religion, nationality, political opinion or membership of a particular social group". Those who claim asylum after having, arrived, lived or worked in the UK are faced with a variety of problems; First asylum law allows automatic refusal and normally the case will be heard by an immigration adjudicator who in most cases decides in favour of the Home Office. However, a legally trained Immigration Tribunal will decide cases using the lower standard of proof and cases are decided on case by case basis depending on individual merit.
However, I want to turn your attention to another aspect of some of the people who end up being in jacobs’s ( not real name) situation. Available information reveals that several Nigerians, South Africans, Tsvanas and even Zambians have claimed asylum in the UK using the Zimbabwean Ticket. I belong to an organisation known as Concerned Citizens of Zimbabwe Action Group, (CCZAG) and one of our main objectives is to guard jealously the integrity of our mother land, Zimbabwe. Whilst, I sincerely sympathise with brother Jacob if his is genuinely Zimbabwean. I still feel that people of other nationalities have joined Mugabe in abusing the integrity of Zimbabwe and that of its nationals. With the new dispensation after the signing of GPA, some of those in the diasporas are likely to return home and may be elected to offices of authority in the new Zimbabwe, where it is paramount that they should advocate for the rule of law and as such will undoubtedly be exposed to deal or decide with issues of law breaking. It is of paramount importance that the Zimbabwean population currently living in the UK should appreciate the rule of law here in the UK. English law makes it an offence for anyone to use forged documents and offenders will equally be prosecuted. It is not high time Zimbabweans should be proud of their country and not allow the name of their country to be misused. It is important in some cases to allow the law to take its course than write countless e-mails canvasing support to stop deportation to some rogue elements who are not even Zimbabweans. I edge fellow Zimbabweans to guard our country jealously and never to allow the integrity of our country to be abused. You might be surprised to learn that some of your genuine claims for asulum as Zimbabweans have been jeopardised by people who falsely claim to be Zimbabweans.
